• THE SALE OF ALCOHOLIC PRODUCTS TO MINORS IS PROHIBITED.
  Users of the www.magashegy-pinceszet.hu website confirm that they are of legal age under the legislation applicable to them. If there is no legislation in this regard, you must be at least 21 years old.
• All retail prices include VAT and do not include any taxes, duties and levies that may be imposed in the destination country of the products and/or services if this is not Italy. These costs vary from country to country and are the responsibility of the customer, who must check the amount with the relevant customs authorities.
• All the wines shown in our store are actually in stock at our premises
• All shipments are insured
• The site is updated several times a day
• The shipment will always be documented with a separate invoice and, unless otherwise specified by the customer, will be made available online on the customer's personal order page ("My Orders").
• The cost of each shipment must be added to the price of the individual product and/or service, the shipping cost may vary depending on the delivery and payment method chosen, as well as on the destination country. The total amount due for the selected products and/or services shall be clearly indicated and provided to the Customer prior to the conclusion of the Contract of Sale.
• The prices shown on the site are subject to variation and/or change by magashegy-pinceszet.hu without any obligation to provide the Customer with prior notice. These changes may be due to increases imposed by Magashegy suppliers, among others. The prices in effect at the time of receipt of the Order shall apply to Contracts of Sale entered into but still in progress prior to the publication of the aforementioned changes.
• Advertised product prices may vary depending on the vintage and size.
• Customers purchasing with Scalapay will be able to receive their order and pay in three instalments. All sales conditions and contractual terms between the customer and the supplier (Scalapay) are independent of Magashegy. By paying with Scalapay on Magashegy, the customer acknowledges the transfer of the instalments to Incremento SPV S.r.l., related parties and their dealers. Please address the service provider, Scalapay, for further information or clarification.

All products are covered by a Legal Guarantee of Conformity, as stated in Articles 128 and subsequent articles of the Hungarian Consumer Code. The Hungarian Consumer Code's Legal Guarantee of Conformity addresses any issues with the conformity of purchased items that exist at the time of delivery and manifest within two years of the date of delivery. Such legal protection does not apply to goods that have been used, damaged, or altered by the end user (the customer).

The customer may request that the vendor replace or repair the item for free, unless the requested replacement or repair is rendered impossible or the vendor charges excessive rates to perform such tasks.

According to the Hungarian Consumer Code, the consumer has the right to a reasonable and fair reduction in the price of the defective product or the resolution of the sales contract. This is especially true if the vendor failed to perform the repair or replacement as expressly stated in the terms and conditions of the Consumer Code, or if the vendor refused to make the goods fit for sale. Finally, if the defect in conformity is severe enough to warrant an immediate price reduction, the consumer has the right to a reasonable and fair price reduction.

If the nonconformity is the result of an error or there are only minor flaws, the consumer has no right to revoke the contract.

To be eligible for this Legal Guarantee of Conformity as defined in the Hungarian Consumer Code, the customer must notify the vendor of the nonconformity in writing, describing and providing proof of the flaws and any other major issues with the product.

Unless otherwise proven, any conformity flaw that appears within a year of the purchase of the good is assumed to be pre-existing, unless such an assumption is incompatible with the nature of the benefit or the nature of the conformity flaw.

Pursuant to European Union Regulation no. 524/2013, European Customers should be aware that the European Commission has set up an online platform that acts an alternative dispute resolution tool.
This tool can be used by any European Customer for out of court settlement of any dispute relating to contracts for the sale of goods and services entered into online and/or arising from the same.
Consequently, if you are a Customer resident in Europe, you may use this platform to resolve any disputes arising from the online contract entered into on this website.

These General Conditions are subject to Italian law as is each Contract of Sale and subject to hungarian jurisdiction.Any dispute relating to the General Conditions or to the Contracts of Sale shall be subject to the jurisdiction of the court where the consumer is resident or domiciled..

Magashegy regret any spelling, typing, or translation errors in its texts, and accepts no liability for any resulting moral or material harm

• These may be returned to magashegy-pinceszet.hu within 14 days of delivery.
• The return shipping costs are payable by Magashegy.
• Defective goods will be replaced or refunded (if out of stock) by Magashegy.

Should you receive a package from Magashegy that has been visibly damaged by the courier (damaged packaging or visibly stained by wine leaking from broken bottles) you have the following options:

• If there are multiple packages, please return the damaged package to the sender and write "With reserve" on the carrier's delivery note. We will then arrange for the damaged package to be replaced and sent out to you again.
• If it is a one-package shipment, please return the shipment to the sender and we will take care of the return and replacement as above.

If the damaged product is out of stock, you will be contacted to arrange a replacement, if you cannot find a replacement product in our catalogue, Magashegy will refund the amount paid.

We are responsible for any shipping costs for returning the damaged package to the sender and resending a replacement.

 Non complient wine

Non-compliant wine means wine that differs from the producer's quality standards. This includes, but is not limited to, the distinctive "corked" smell and taste, rather than leaking liquid or a label that has been ruined in transit.

Non-compliant wine can be replaced, provided it is still available, at no extra cost to the customer. If the wine is no longer available, the price paid will be refunded.

As soon as the customer notices an alleged non-compliance, he/she must report the alleged non-compliance of any bottles from any of the wineries by email to helen.magashegy@gmail.com within 24 months of purchase and no later than two months of discovering the defect. This report must be accompanied by the Magashegy order number and the collection address, as well as a description of each individual bottle believed to be non-compliant and the quantity in question.

Magashegy will then arrange for a courier to collect the product free of charge from the address provided in the email.

The product or products must be returned with at least 2/3 of the original contents and sealed with the original cork suitably trimmed. The return package must be handed to the courier in its original packaging to protect the wine in transit. This procedure must be followed for Magashegy to be reimbursed by the producer or its representative.

Once the wine has been returned and its non-compliance checked, a new shipment of bottles of the same type and vintage will be arranged immediately, if available, otherwise the price paid will be refunded immediately.

The procedure we follow uses as little paperwork as possible for the relevant checks and is completely free of charge to the customer.

In the event of a dispute, the bottles will remain available at Magashegy for any further action by the relevant authorities and the customer will be charged for the cost of the courier collection.

Information about the right of withdrawal

Purchases on the magashegy-pinceszet.hu website are subject to the provisions of the hungarian Legislative Decree 206/2005 and Legislative Decree 21/2014, which guarantees you the right to withdraw from the purchase agreement for any reason whatsoever.

You have the right to withdraw from the contract, without providing any reason, within 14 days. The withdrawal period expires 14 days after the day on which you or a third party other than the carrier and nominated by you take physical possession of the goods.

In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract in an unambiguous statement, e.g. a letter sent by e-mail to helen.magashegy@gmail.com or by post to the following address: Kisapáti, Kisapáti-hegy, 1256/4, Hungary.

In order to comply with the withdrawal period, you just need to send the notification that you wish to exercise your right of withdrawal before the withdrawal period expires.

If you withdraw from this contract, you will be refunded all payments you have made to us, including delivery costs (except any additional costs resulting from you choosing a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. Refunds may be issued after the 14 day period only as long as you have proved that you have returned the goods or until they are received by us, whichever is sooner.

Such refunds will be made tp the same payment method that you used for the initial transaction, unless expressly agreed otherwise; in any event, you will not incur any costs as a result of such a refund. The refund may be withheld until receipt of the goods or until you have proved that you have returned the goods, whichever is the earlier.

You are only liable for any reduction in the value of the goods resulting from any handling of the goods other than that necessary to establish the nature, characteristics and proper performance of the goods.

Please return the goods or surrender them to us without undue delay and in any event within 14 days from the day you notify us of your withdrawal from this contract. The deadline is deemed to have been met if you return the goods before the 14 day period has expired.

You are responsible for the direct costs of returning the goods.

The purchased goods must be fundamentally intact; we recommend that you take extra care when repackaging the goods, for example by using the original packaging.

The following cases as referred to in Article 59 of the Hungarian Consumer Code are exempt from the right of withdrawal:

• The supply of goods made to measure or clearly personalised;
• The supply of sealed goods that are not suitable for return for hygiene or health reasons and have been opened after delivery;
• The supply of goods which are by their nature inseparably mixed with other goods after delivery;
• The supply of alcoholic beverages, the price of which has been agreed at the time the sales contract is entered into, the delivery of which can only take place after thirty days and the actual value of which depends on fluctuations in the market that are beyond the control of the trader;
